Trump Administration Introduces Gold, Corporate Gold, and Platinum Cards
The Trump Administration has unveiled a new framework that creates donation based immigration pathways tied to existing employment-based categories.
What are EB-1A and EB-2 NIW?
• EB-1A (Extraordinary Ability): For individuals with sustained acclaim in their field, often referred to as the “Einstein visa.”
• EB-2 National Interest Waiver (NIW): For professionals with advanced degrees or exceptional ability whose work benefits the United States.
Both EB-1A and EB-2 NIW are reserved for individuals of exceptional caliber. EB1A, often called the “Einstein visa,” targets those with extraordinary ability and international recognition. EB-2 NIW, while somewhat more flexible, still demands a high level of achievement and proof that the applicant’s work serves the national interest. Historically, both categories have required extensive documentation to demonstrate eligibility, but they allow applicants to obtain permanent residence without going through the labor certification process.
Donation-Based Qualification
With the new framework, applicants may bypass these evidentiary burdens by demonstrating eligibility through a direct contribution.
• Individuals: A $1 million donation qualifies as sufficient proof for permanent residence.
• Corporations: A $2 million donation allows a company to sponsor a foreign employee, with the possibility of transferring the sponsorship between employees.
EB-1 and EB-2 at the Core
The Executive Order makes clear that these programs will primarily operate under EB-1A and EB-2 NIW. While there is a passing mention of EB-5 as something to be “considered,” no structure or mechanics are provided, making EB-5 a secondary possibility at best.
The Platinum Option for the Ultra-Wealthy
The Trump Platinum Card requires a $5 million donation and offers the ability to spend up to 270 days a year in the United States without being taxed on non-U.S. income. For ultra-high-net-worth individuals worldwide, including the MENA region, this option could prove especially attractive to those who want U.S. access but have hesitated due to tax exposure.
What’s Next
The Executive Order directs DHS and the Department of Commerce to issue implementing procedures within 90 days. Until then, no applications can be filed.
A Reliable Constant: EB-5
Even as these new donation-based cards emerge, the EB-5 program remains a solid, congressionally authorized route for permanent residence through jobcreating investment. EB-5 is secure through September 30, 2027, and cannot be undone by executive order.
