What Happens to Your H-1B After Filing for EB-5?

Filing an EB-5 petition does not cancel or impact your H-1B. You can keep working on your H-1B as long as it remains valid.

If you concurrently file Form I-485, you gain additional work and travel options through your EAD and Advance Parole. Many applicants continue using H-1B as a fallback option until their EB-5 green card is approved.

Takeaway: H-1B and EB-5 can coexist. Be sure to track expiration dates and keep both paths viable until your green card is in hand.
